Gaithersburg is one of the larger incorporated cities in Montgomery County with a population of about 70,000 residents. Unlike unincorporated communities in the county, Gaithersburg has its own city government. But for divorce cases, that does not change anything. Maryland circuit courts handle divorce at the county level, so Gaithersburg residents file at the Montgomery County Circuit Court in Rockville just like everyone else in the county.

The courthouse is at 50 Maryland Avenue in Rockville, about 7 miles south of Gaithersburg along I-270. The Family Department handles all divorce filings. The court has a drop box outside the building available 24 hours a day, marked "Family Department." You can leave papers any time without going in. Do not put payment in the drop box. Staff will contact you with the cost after locating the file. This is also true for mailed requests.

Gaithersburg Divorce Filing Process

Gaithersburg residents must meet residency rules before filing. Under Maryland Family Law § 7-101, at least one spouse must have lived in Maryland for six months before filing the divorce complaint.
